Proposed Constitutional Amendments

 

AMENTMENT 1

Insert a new definition in Article 2.1:

2.1 (X)  “Electoral District Association” or “EDA” means a riding association or constituency association certified as an electoral district association of the Party under the Canada Elections Act.

Rationale

The LPC(M) Constitution does not include a definition of “Electoral District Association”.  This amendment simply provides clarity.

 

AMENDMENT 2

Delete Article 5.1 (e).

Insert “Fundraising” in Article 5.1 (h) between “Communications and Publicity” and “Membership”

Delete Article 7.3.

Insert “Fundraising” in Article 7.4 between “Communications and Publicity” and “Membership”

Rationale

The Liberal Party of Canada amended its Constitution at the Biennial Convention eliminating the National Revenue Committee.  This amendment eliminates references in the LPC(M) Constitution to the National Revenue Committee and places the Fundraising Committee with the other Standing Committees.

 

AMENDMENT 3

Insert a new Article:

5.1 (i) the chair of the Victory Fund Committee (non-voting);

Insert a new Article:

5.1 (j) the Chair of the Laurier Club (non-voting);

Delete Article 5.1 (g).

Rationale

The Liberal Party of Canada passed a resolution at the Biennial Convention providing recommendations on restructuring the Party.  Recommendation 13(viii)(a) recommends that all PTA Executives include a Victory Fund chair and Laurier Chair as non-voting Executive members.  Recommendation 13(viii)(b) directs PTAs to review their Constitutions so that redundant positions are eliminated.  Since the LPC(M) Board of Directors meetings are open to all members of the Party, there is no need to include members of the National Board of Directors residing in Manitoba as LPC(M) Board members.

 

AMENDMENT 4

Replace Article 5.1 (d) with the following:

5.1 (d) two members of the National Election Readiness Committee representing Manitoba, who shall serve as Co-Chairs of the Manitoba Campaign Committee, one of whom shall be appointed by the National Campaign Co-Chairs pursuant to Article 39 (1) (d) of the Constitution of the Liberal Party of Canada and shall serve until replaced by the National Campaign Co-Chairs, and one of whom shall be elected by the Board of Directors and shall serve until such time as a replacement is elected by the Board of Directors;

Rationale

The Liberal Party of Canada amended its Constitution at the Biennial Convention to require that one Campaign Co-Chair in each PTA be elected by the PTA in accordance its bylaws.  The body responsible for electing the co-chair is not specified.  The Constitution Committee recommends that the co-chair be elected by the Board of Directors, which contains representation from all component parts of the LPC(M), including EDA presidents.

 

AMENDMENT 5

Insert a new Article:

ARTICLE X – SUPPORTERS OF THE PARTY

X.1         Qualification to be a Supporter of the Party:  Admission to the Party as a Supporter is, subject to this Article, open to all without discrimination based on race, national or ethnic origin, colour, religion, sex (gender), sexual orientation, age or mental or physical (ability).  To be eligible to be admitted to the Party as a supporter a person must:

(a)  be at least 18 years of age;

(b)  support the purposes of the Party;

(c)  be qualified as an elector who may vote in accordance with part 11 of the Canada Elections Act or ordinarily live in Canada; and

(d)  not be a member of any other federal political party in Canada.

X.2         Application and admission:  A person may apply for admission to the Party as a Supporter by completing an application form and delivering it to the Chief Office of the Party or such other office as may be designated by the Board of Directors or by submitting it electronically in a manner prescribed by the National Board of Directors of the Liberal Party of Canada.

X.3         Effective Date:  Upon receipt of a completed application in accordance with paragraph 4.2, and providing that the applicant is qualified in accordance with this Article, the applicant shall be registered by the Party as a Supporter of the Party.

X.4         Term of registration as a Supporter:  A person ceases to be a Supporter of the Party:

(a)  when the person no longer meets all of the requirements of X.1(a) to (d) inclusive;

(b)  when the person’s registration is terminated by the Board of Directors; or

(c)  when the person advises the Party that he/she no longer wants to be registered as a Supporter.

X.5         Right to Notice:  Where the Board of Directors seeks to terminate a registration, it shall provide written notice informing the person so affected:

(a)   of the reasons it wishes to terminate the registration; and

(b)  of the right to a hearing before the Board of Directors.

X.6         Members are Supporters:  A member of the Party is deemed to be a supporter of the Party and has all the rights of a supporter.

Rationale

The Liberal Party of Canada amended its Constitution at the Biennial Convention to create a “Supporter” category.  This amendment provides recognition for this new category of Liberals in the LPC(M) Constitution.
